Hefty fines for two companies for market abuse under the ARENH mechanism

As part of its responsibilities to ensure the proper functioning of the retail electricity market and guarantee effective consumer protection, the CRE launched two investigations in late 2022 and early 2023 into the practices of Mint and those of BCM Energy and Oui Groupe (now Elmy Groupe) in particular. Following these investigations, the President of the CRE submitted two requests for sanctions to the CoRDiS in October 2023.

On 3 July 2025, CoRDiS imposed a financial penalty of €3.5 million on Mint and a financial penalty of €3 million on BCM Energy for having each committed abusing the right of access to historical nuclear electricity (ARENH) during 2021 and 2022, after clearing Elmy Groupe, the parent company of BCM Energy, of any wrongdoing.

The CRE welcomes these important decisions, which penalise electricity suppliers for abusing the ARENH right and thus ensure that any market malfunction is punished, to the benefit of consumers.

The CRE is continuing its checks and exercising the utmost vigilance in detecting abusive practices by certain operators in order to promote the proper functioning of the market and strengthen consumer confidence. In the autumn, it will publish the results of its checks carried out as part of the implementation of the guidelines and will present its initial recommendations on prudential rules.
