SEWRC adopted a decision concerning transmission and distribution networks access prices, as well as a compensation mechanism

In a closed session held today (13 March 2014) the State Energy and Water Commission (SEWRC) adopted a decision, endorsing electricity transmission network access prices of “Electricity System Operator” EAD, as follows:
- For electricity producers from wind or solar, purchased at feed-in tariffs – 2.45 BGN/MWh, without VAT.
- For electricity producers from renewable sources, different from wind or solar, purchased at feed-in tariffs – 0.00 BGN/MWh.
The prices are due to the “Electricity System Operator” EAD by all the producers of electricity from renewable sources, purchased at feed-in tariffs, regardless of the connection point.
Producers, connected to the electricity distribution networks, pay the prices to the operators of the electricity distribution networks, which transfer them to the “Electricity System Operator” EAD.
There have been endorsed also access prices for the distribution networks of “CEZ Distribution Bulgaria” AD, “EVN Bulgaria Elektrorazpredelenie” EAD and “Energo-Pro Grid” AD for electricity producers from renewable sources, purchased at feed-in tariffs – 0.00 BGN/MWh.
Given that the adopted access prices differ from the set with SEWRC’s Decision “Ц?33/14.09.2012” temporary access prices, the Commission also determined compensation measures, which reflect the different cases arising from the decision on the final prices. Through the compensation mechanism SEWRC seeks to recover costs already incurred by different producers, as well as to secure those proven by the “Electricity System Operator” EAD.
Regarding the producers connected to the transmission network of “ESO” EAD: in the cases, in which the final price is lower than the temporary one, “ESO” EAD refunds the difference to wind and solar electricity producers that sell at feed-in tariffs, for the period since 14 September 2012 till 13 March 2014.
In those cases, in which the final price is higher than the temporary one, the producers refund the difference to “ESO” EAD.
Regarding the producers connected to the distribution networks: in case the final price is lower than the temporary one, the electricity distribution company refunds the difference to the wind and solar electricity producers and transfers to “ESO” EAD the final access price.
In case the final price is higher than the temporary one, the wind and solar electricity producers refund the difference to the electricity distribution companies and they in turn – to “ESO” EAD.
If producers of renewable sources electricity have appealed SEWRC’s Decision “Ц?33/14.09.2012” and it has been repealed for them by an effective court decision, they have the possibility to recover the amounts to their full extent under the current civil legislation.
To the producers of renewable sources electricity, different from wind and solar, that has not appealed or there is no an effective court decision for them – the operators of the networks, to which they are connected, are obliged to recover 100% of the amounts collected.
The deadline for implementation of the compensation measures is 15 April 2014.
