That is the most important of them:<\/span><\/p>\n<p style=\"font-weight: 400;\"><strong><em><span>5% of the monthly revenues of all producers and traders of imported electricity &#8211; in a fund for financial support of PP<\/span><\/em><\/strong><\/p>\n<p style=\"font-weight: 400;\"><span>With a series of new texts (Art. 36b \u2013 36g and subsequent of the Energy Act\/EA) the legislator structured a fund in which to collect money for the purpose of &#8220;covering the expenditure, paid by the Public Provider, arising from its obligations under Art. 93a of the EA, decided by the Commission, including for past regulatory periods.&#8221;.<\/span><span><br \/>\n<\/span><\/p>\n<p style=\"font-weight: 400;\"><span>The fund will have two basic sources:<\/span><span><br \/>\n<\/span><\/p>\n<p style=\"margin-left: 18.0pt; mso-add-space: auto; text-indent: -18.0pt; mso-list: l0 level1 lfo1;\"><span>\u2212<span>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><\/span><span>contributions amounting to 5 percent of the monthly revenues from sales of all producers of electricity in the country and those of traders regarding imported and sold in the country electricity;<\/span><\/p>\n<p style=\"margin-left: 18.0pt; mso-add-space: auto; text-indent: -18.0pt; mso-list: l0 level1 lfo1;\"><span>\u2212<span>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><\/span><span>revenues from the auctions for the sale of carbon allowances, used for the development of RES.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span>Important for producers with regulated revenues clarification is made in Art. 36f, par. 4, namely that for the purposes of price regulation, the cost of these 5% contributions will not be included in the recognized by the Energy and Water Regulatory Commission\/ EWRC costs.<\/span><\/p>\n<p style=\"font-weight: 400;\"><strong><em><span>The network operators also will pay the\u00a0 political support costs under Art. 34 and Art. 35 of the Energy Act<\/span><\/em><\/strong><\/p>\n<p style=\"font-weight: 400;\"><span>With the additions of par. 6 of Art. 34 and par. 5 Art. 35 (as well as others in Art.30, par. 1, item 7, Art. 34, par. 6, Art. 100, par. 3 and par. 4 of the EA) was imposed an obligation on the network operators to pay like final household and non-household customers the costs of public service obligations and stranded costs under Art. 34 and Art. 35 of the EA.<\/span><\/p>\n<p style=\"font-weight: 400;\"><strong><em><span>Limiting the quantities of RES energy, purchased at preferential prices\u00a0<\/span><\/em><\/strong><span>\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span>With the legislative changes in July, except the above five-percent tax on monthly revenues, to the RES producers will be applied a new principle to limit the costs for their support &#8211; at a preferential price will only be purchased the quantities up to the amount of &#8220;net specific production &#8220;(NSP). NSP is defined as &#8220;an average annual production of electricity from 1 kW of installed capacity as decided by EWRC for approval of the preferential prices, after deduction of their own needs.&#8221;.\u00a0<\/span><span>According to \u00a716 of the\u00a0<\/span><span>Transitional and Final Provisions<\/span><span>\u00a0of the\u00a0<\/span><span>Act for\u00a0<\/span><span>Amendment of the Energy Act<\/span><span>,<\/span><span>\u00a0the regulator, within 31.07.2015 must establish by\u00a0<\/span><span>its<\/span><span>\u00a0decision\u00a0<\/span><span>the\u00a0<\/span><span>NSP\u00a0<\/span><span>for\u00a0<\/span><span>electricity on the basis of which\u00a0<\/span><span>the<\/span><span>\u00a0preferential prices\u00a0<\/span><span>in the respective EWRC\u2019s decisions are approved,\u00a0<\/span><span>prior to the entry into force of\u00a0<\/span><span>current legislative change<\/span><span>.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span>The changes of the Law on Energy by Renewable Sources\/LERS by Amendments of the EA (Art. 31, par. 5, item 2 and par. 12) present two alternative ways to sell the energy that would be outside the volume of the NPS, namely: 1) to sale to the PP or to Public Suppliers on price for excess on the balancing market and 2) to supply their own facilities or to sale electricity at freely-negotiated prices and \/ or at the balancing market.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span>In addition, two successive amendments to the EA in March and in mid-May (new Art. 80a) to the Public Financial Inspection Agency is given a right to carry out audits not only in the state-owned, but also in all energy companies with regulated prices, including \u2013 with preferential prices. The first objects in the implementation of new functions of the state body are among RES producers as the inspectors have one year to complete its tasks.
